The Supreme Court on Monday granted virtual approval to the government’s move to make Aadhaar compulsory for bank accounts, I-T returns and PAN cards. The Supreme Court today made it clear that Aadhaar cards cannot be made mandatory by the government and its agencies for extending benefits of social welfare schemes.A bench comprising Chief Justice J S Khehar and Justices D Y Chandrachud and S K Kaul, however, said that government and its agencies cannot be stopped from seeking Aadhaar cards for non-welfare schemes like opening of bank accounts.The bench also said that a seven-judge bench needed to be constituted for authoritatively deciding a batch of petitions challenging the Aadhaar scheme on grounds including that it infringes on the Right to Privacy of citizens.It, however, expressed inability in setting up of the seven-judge bench saying it would be decided at a later stage. The Supreme Court is of the opinion that the government cannot make Aadhaar cards, with their Unique Identification (UID) scheme numbers, mandatory for extending benefits of its welfare schemes. However, the court on March 27 saw no problem in Aadhaar cards being used in issues such as opening of bank accounts, etc.These were just observations by the apex court when senior advocate Shyam Diwan brought up the issue before the Chief Justice of India JS Khehar for urgent hearing. Diwan read from the October 15, 2015 order of the apex court, by the then CJI, which said that the matter should be disposed of as soon as possible.The CJI said that since this was an important matter, the apex court will have to constitute a seven-judge bench and that “this will take time”. Sharpening its attack on black money, the government on Tuesday proposed lowering the limit on cash transactions to Rs 2 lakh instead of Rs 3 lakh announced in this year’s Budget.The government also proposed to make Aadhaar card mandatory from July 1 for filing income tax returns. Aadhaar will also be required for seeking the permanent account number (PAN).The proposals came as Finance Minister Arun Jaitley created history by moving as many as 40 amendments to the Finance Bill.
